The online store www.sistemecofraje.ro contains any kind of information (texts, pictures, databases, products, prices, logos, advertisements), which constitutes the content of the online store www.sistemecofraje.ro, the property of the company SISTEME COFRAJE. Any takeover of the content (in whole or in part) for purposes other than personal interest is sanctioned by the legislation on intellectual property rights.

The information offered within the site is in Romanian, without excluding their presentation in other languages as well. The sales contract is concluded in Romanian or English.

Access to and / or use of the site by you constitutes ACCEPTANCE of these conditions and will oblige you to comply with them.

Any information regarding the contract concluded between you and SISTEME COFRAJE will be stored for a limited time and will be available to third parties only at the request of the judicial bodies.

Any confirmed order involves the seller and the consumer – natural person in a distance contract.

The contract is concluded between SISTEME COFRAJE, as seller and the consumer. The consumer will exclusively use the communication technique included in the online store, before and at the conclusion of this contract;

The contract with the consumer (either individual or company) is considered concluded when the consumer receives its confirmation from the seller.

Regarding the relevant codes of conduct, according to art. 8 lit. e) of Law no. 365/2002 on electronic commerce, Law 363/2007 on combating incorrect practices, please consult the specific legislation displayed on the ANPC website, section “Normative acts”.

The provisions of the present distance contract are also completed with the law 365/2002 regarding the electronic commerce republished and modified and with GEO 34/2014 regarding the consumers’ rights within the contracts concluded with the professionals.

Definitions of this document:

SISTEME COFRAJE accepts the conclusion of commercial contracts by electronic means and thus undertakes to comply with the legislation applicable to this conclusion, validity and legal effects of these contracts. In the content of this document, the following terms used in capital letters will have, if the context does not result otherwise, the meanings specified below:

USER: any person who visits and / or interacts with the SISTEME COFRAJE website;

SELLER: OBERHAUSER INVEST SRL with headquarters in Baia Mare, str. Dealul Florilor, no. 14B, Maramures county, postal code 430165, country Romania, registered at the Trade Register under no. J24 / 400 / 29.04.2013 and having C.I.F .: RO 31589810, no. phone: 0362.803.597, hereinafter referred to as SISTEME COFRAJE.

BUYER: Any individual or company who places an order in the online store www.sistemecofraje.ro and who has accepted the terms and conditions of this distance contract.

ONLINE STORE: web page belonging to Sisteme Cofraje: www.sistemecofraje.ro, through which the buyer has access to information on products offered for sale by SISTEME COFRAJE. In the online store SISTEME COFRAJE are made available to buyers for sale products from the physical store, from Baia Mare, SISTEME COFRAJE. Depending on availability, products may have multiple statuses.

GOODS: products made available to the buyer for sale by the seller through the online store SISTEME COFRAJE.

ONLINE ORDER: online communication between the seller and the buyer, through which the buyer intends to purchase goods from the seller, which the latter agrees to deliver, and the buyer agrees to pay. For products that are not in current stock, the seller can order them from the supplier, following the customer’s request in the store, but the delivery time for such orders exceeds the normal delivery time of 24 hours – 5 calendar working days;

ORDER CONFIRMED: the order made online through www.sistemecofraje.ro by a buyer whose identification data and details regarding his order were validated by phone as a result of the contact between him and the operator of the SISTEME COFRAJE customer support service.

NEW CUSTOMER: customer who intends to purchase products from the online store Sisteme Cofraje for the first time and who requires a telephone validation of the order made by the customer support service operator designated by SISTEME COFRAJE.

Opening hours:

Orders can be placed online at any time, but their processing period takes place daily between 8-21.

Orders placed on Saturdays, Sundays and public holidays will be processed on the next working day.

If the customer is new, the seller assumes acceptance of the order from the buyer when there is a confirmation by phone or e-mail.

Once the online order is launched, the buyer agrees with the subsequent form of communication (telephone or electronic), as well as with the seller’s mode of operation.

Obligations of the seller:

The seller provides the buyer, free of charge, with professional information about its products and services, in order to achieve the purpose mentioned in the online order. The content published in the online store SISTEME COFRAJE is indicative and presents information about the products sold by it, as well as other data considered by SISTEME COFRAJE as being of interest to BUYERS.

SISTEME COFRAJE is the owner of all intellectual property rights over the online store, respectively over the brands, design, site functionalities, images and technical specifications.

The characteristics of the products and their related technical documentation, presented on the site, are made available by the manufacturers and suppliers, and SISTEME COFRAJE offers the technical support for their display. The seller constantly takes steps to present the most accurate and relevant information for the products offered for sale. If the prices or other information about the product have been displayed incorrectly, we reserve the right not to honor the order and to notify the customer about the error if the delivery has not been made.

The images of the products are displayed in the online store for presentation. The products actually ordered may differ in terms of characteristics (eg shades of color) from the actual appearance of the product, depending on the batch in which they were manufactured.

In order to carry out the commercial contract in good conditions, SISTEME COFRAJE, based on the agreement expressed by the client, can contact the client by e-mail or telephone, if after the interaction with the site he completes the identification and contact data. The purpose for which the customer will be contacted is to expressly request any information for the completion of the online ordering process.

At the request and with the consent of the consumer, SISTEME COFRAJE can recommend the purchase of another product of a quality and at a price equivalent to those requested in the first order. The initial order is considered canceled on the date of confirmation of the new order (order of the product / products that replace the initial product.)

All prices related to the Goods in the online store are expressed in lei (RON) and include VAT. Also, the price of electronic goods includes the stamp duty, displayed on the product page. Product prices are updated daily.

The price of the ordered product is the one displayed on the date of placing the order.

Promotions are valid:

– for limited periods of time, specified on the product presentation page of the online store;

– within the limits of available stocks. The products, prices and information on stock availability displayed in one of the online stores Sisteme Cofraje related to a city may be different. Sisteme Cofraje cannot be held responsible for damages caused by information published in the online store due to errors that do not belong to it.

SISTEME COFRAJE reserves the right to complete and / or modify any information in the online store without prior notice to users of the site.

The communication with us is available simply by publishing your opinions regarding our products and services, through the available contact form, through the e-mail address contact@sistemecofraje.ro and / or by phone at the number of phone 0362.803.597 or 0757.578.576. SISTEME COFRAJE reserves the right to contact the shop’s visitor by e-mail or telephone if, following the interaction with the site, he completes the identification and contact data and expressly requests any type of information available.

The ordering process

The customer can launch an online order from the product listing page or the individual product page, and will complete the order after selecting a payment and delivery method. The products added to the shopping cart do not attract the registration of the order or the reservation in the store of the goods added to the basket.

In order to successfully complete the ordering process, the customer assumes that all the contact details provided by him are complete and correct. If necessary, for the successful completion of the order the buyer can be contacted by the seller through the available means agreed by him with the provision of contact details.

When ordering online with courier delivery, customers will be contacted by our Customer Support Service to confirm the order by phone.

The seller reserves the right to cancel the order placed by the buyer, in one of the following cases:

– If the payment was not accepted by the payment processor approved by Sisteme Cofraje – the data provided by the customer are erroneous / incomplete;

– The card / transaction is not accepted by the issuing bank;

– Payment made by PO (bank transfer / internet banking), was not made in 3 working days

– Delivery by courier / Sisteme Cofraje’ fleet was not possible (eg the customer can not be found by telephone and / or physical courier, at the address indicated for the delivery of purchased goods, etc.);

In case of cancellation of the order, none of the parties involved will claim / request damages.

According to GEO no. 34/2014 the buyer has the possibility to withdraw from the contract within 14 days from its conclusion. More details on this aspect can be found here.

In our online store, the products are displayed with several types of availability, depending on which products can be ordered online. More details on product availability can be found here.

In order to optimize the online ordering service, Sisteme Cofraje reserves the right to restrict customers access to certain facilities of the online store, such as the impossibility of completing an online order if the customer has not created a user account.

Also, some facilities, made available to customers in the online store, such as delivery and payment methods, may be conditioned / restricted depending on stock conditions and specific delivery methods.

For good reasons, related to the damages caused to the company, Sisteme Cofraje may restrict the access of some customers to certain facilities made available in the online store, such as payment and delivery methods. For more specific details, related to the reasons that led to these measures, the clients in question can contact the Customer Support Service via e-mail contact@sistemecofraje.ro or at telephone number 0362.803.597.

In the case of electronically paid orders, the Seller cannot be held responsible for any other costs incurred by the Buyer, such as for example operating fees, currency conversion fees (if payment is not made in lei) applied by the issuing bank of his card. The responsibility for this action lies solely with the Buyer. The entire responsibility lies with the client and any disputes will be resolved between him and the card issuing bank.

Intellectual property right

The website content, including, but not limited to, graphics, names, trademarks (such as: site and company name Sisteme Cofraje, symbols, images, text, multimedia files) are the property of OBERHAUSER INVEST SRL and cannot be taken over and / or used without the prior written consent of the owner.

Website visitors have the opportunity to copy information from this site, to use it only for personal, non-commercial purposes and without deleting or modifying it. Modification or use of the materials on this site for purposes other than information, respectively use as a customer, is strictly prohibited.

By accessing this site, visitors agree that any name, logo, trademark or trademark of services, texts, documents and media files presented on this website are owned by Sisteme Cofraje and may not be used by the user except for informative purpose. Sisteme Cofraje will act by legal means if the intellectual property rights and copyrights are infringed.

If Sisteme Cofraje grants the Visitor / Customer the right to use the content of the site in a certain way, he will use it only for the purpose for which it was defined and for a period defined in the agreement.

Limitation of liability

Under no circumstances Sisteme Cofraje will be liable for any direct, indirect, accidental, special damages resulting from the use or inability to use this site and will not be liable for any damages resulting from errors, omissions, interruptions, errors, malfunctions, delays in operation or transmission or any failure to perform the site.

Once the client account is created and used, the user is responsible for maintaining the confidentiality of the login data (access). The user will keep the confidentiality of the user and the password and will use it responsibly for the management of the orders and facilities made available in the client’s account.

Users agree not to share or transfer passwords or any other access information to any other third party. Users assume sole responsibility for the use of the account and the confidentiality of the password.

Sisteme Cofraje cannot be held liable for damages resulting from the loss of purchased goods or the use of the Goods after delivery, except for the legal and conventional guarantees granted.

Sisteme Cofraje owns the right to modify at any time the terms and conditions of the site and the general conditions in which the online ordering process takes place. The customer confirms that he accepts these terms and conditions by checking the “checkbox”. I agree with the terms and conditions. The concluded commercial contract is carried out under the terms and conditions valid on the date of the agreement of wills.

By publishing user-generated content on the Sisteme Cofraje website, you offer us a non-exclusive, perpetual, irrevocable, unlimited territorial license without obliging the company to make any payment to the user / customer or to a third party.

This license includes the right to host, reproduce, modify, adapt and distribute any user content published on the Sisteme Cofraje website. Recommendations, suggestions and rules for publishing opinions on the Sisteme Cofraje website:

– Opinions are posted on the site in maximum 3 working days from the date of their transmission, if the recommendations and suggestions from this section are observed;

– When you consider that an opinion violates these recommendations, please report this to us at contact@sistemecofraje.ro;

– The pertinent and sincere opinions about the products will be published on the site;

– In expressing opinions, please be as specific as possible (what you liked, what you did not like about the product);

– We reserve the right not to publish opinions that contain insulting or defamatory language, criticism of other customers who have posted previous messages;

– We reserve the right not to publish messages that refer to the products and offers of other companies, contacts or any link to them (website address, e-mail address, contact details, physical address, etc.);

– We reserve the right not to publish opinions that intentionally mislead the client, malicious, false or incomplete opinions.

Advertising and confidentiality

The buyer will not make public, to third parties, by any means, any private information received from the seller, under the sanction of obliging him to pay damages.

The seller reserves the right to use the information provided by the buyer in order to perform the commercial contract. Also, the buyer will not make public to any third party any information regarding the order without the written consent of the Seller.

The Seller reserves the right, based on the user’s consent, to store and use in its own interest, in order to carry out marketing activities, any information provided by the buyer through the website www.sistemecofraje.ro. Also, it will not provide to any third party the information received from the buyer, except for the agreed partners, service providers with which there is a contract that protects this data received from the buyer.

Remarketing terms

By using a remarketing tag on www.sistemecofraje.ro and the conversion code received from Google AdWords, cookies are collected.

An internet cookie is a small file, consisting of letters and numbers, that will be stored on the computer, mobile terminal or other equipment of a user from whom the Internet is accessed. Cookies allow the site to provide personalized information to the user.

Invoicing and issuing the accompanying documents of the package

The seller will issue an invoice for the delivered goods based on the information held by him and those provided by the buyer. At the same time, the package / goods will be accompanied by the documentation sent by the supplier and provided by law for the ordered product (s), as the case may be: certificate / declaration of conformity, guarantee certificate, instructions for use, etc.

The prices of the products displayed within the site www.sistemecofraje.ro include VAT according to law.

The client has the obligation to provide complete and correct data, necessary for issuing the invoice according to the legislation in force. In this sense, Sisteme Cofraje will not request the customer, through the forms present on the site, other information, of a confidential nature than those necessary for issuing the invoice, delivering the products or completing the online ordering process.

Sisteme Cofraje will send the customer the invoice related to the order, both in electronic format, available online in the “Customer Account” and in physical format, once the delivery of the Goods. Thus, the client has the possibility to have a record of the issued invoices.

In order to successfully complete the online ordering processes, the customer has the obligation to update the personal information in his account.

If the invoice is not available in the client’s account, within a maximum of 48 hours from the receipt of the goods, he is asked to send a notification to the e-mail address contact@sistemecofraje.ro.

Risks and responsibilities

The seller is responsible for the proper packaging of the goods.

At the client’s request, we provide the technical file of the sold product.

The risk of loss of the goods is transferred to the buyer at the time of the actual delivery of the good.

The seller assumes responsibility for the delivery of products ordered by the buyer.

Delivery and acceptance of goods

The Seller undertakes to deliver the goods through the approved courier companies or the means of transport Sisteme Cofraje to the Buyer according to the Customer’s choice.

The delivery of the goods is made only on the Romanian territory.

The buyer will become the owner of the goods after signing the transport document and making the payment (if it has not been previously made by card or bank transfer) to the courier or the Sisteme Cofraje staff.

Also, the consumer (individual or company) has the right to return the products within 14 days from their purchase. Please access the general return conditions.

Major force

Force majeure (unpredictable, uncontrollable and unavoidable event that affects the performance of the contract) exonerates the party invoking it from liability.

Litigation. Applicable law

The contractual relations between the parties are governed by Romanian law. Any dispute that cannot be settled amicably will be sent for resolution to the competent courts.
